1. Introduction

Welcome to 22pack, a brand operated by Richard Pruzek. These Terms and Conditions outline the rules and regulations for the use of our website, located at https://22pack.com. By accessing this website, we assume you accept these terms in full. If you do not agree with any part of these terms, you must discontinue use of our website.

These Terms are supplemented by our Refund and Returns Policy and our Privacy Policy, which form part of these Terms.

2. Products and Services

22pack offers customized packaging products and stock packaging products for sale. Specific information about each product can be found on our website.

3. Orders and Obligation to Pay

3.1 Binding order. By completing the checkout process and clicking the order button, you place a binding order and you are obliged to pay the total price shown, including any shipping costs and applicable VAT. We will then send you an order confirmation by email. The order confirmation records what has been agreed between us — the products, quantities, price and delivery terms — and takes effect as a binding agreement between you and Tamaraceite s.r.o., governed by these Terms and Conditions.

3.2 Bank transfer. Where you select bank transfer as your payment method, you are obliged to pay the full invoiced amount to the bank account stated on our invoice, by the due date stated on that invoice, quoting the order number as the payment reference. Choosing bank transfer does not make the order provisional or cancellable — the obligation to pay arises when the order is placed, not when the transfer is made.

3.3 Non-payment. If the invoiced amount is not paid by the due date, the full amount remains due and payable. We may charge statutory default interest from the day following the due date and recover the reasonable costs of collection, including reminder, debt-recovery and legal costs.

Where goods have already been dispatched, they remain the property of Tamaraceite s.r.o. until the purchase price has been paid in full. The obligation to pay is not affected by what subsequently happens to the goods: it survives in full where the goods have been used, processed, resold, given away, lost or otherwise disposed of. Non-payment does not entitle you to retain the goods, and returning or offering to return goods after delivery is not a substitute for payment and does not give rise to any right of withdrawal or refund under our Refund and Returns Policy.

3.4 Customized products. Because customized products are manufactured to your specification and have no resale value to us, orders for customized products cannot be cancelled once production has started, and the obligation to pay stands in full.

4. Returns and Refunds

4.1 Consumers. If you are a consumer, you may return non-customized stock products within 14 days of delivery, free of charge and without giving a reason. “Free of charge” means we do not charge any restocking or handling fee; the cost of return shipping is borne by you. Packaging must remain unopened, as our products are intended for food contact and an opened seal cannot be guaranteed hygienically fit for resale.

4.2 Business customers. The statutory 14-day right of withdrawal applies to consumers only. Where you purchase in the course of your trade or business (including where you provide a VAT or company registration number), we may still accept a return within 14 days as a voluntary commercial gesture, but we reserve the right to decide each such request individually and at our discretion, and to refuse or reduce a refund — in particular where we identify misuse of the returns policy. Misuse includes, without limitation: returning goods ordered in quantities inconsistent with genuine business need, repeated ordering-and-returning patterns, returns of goods stored outside our specified conditions, goods offered for resale, and returns used to offset over-ordering.

4.3 Customized products. Customized products are made to your specification and cannot be returned. Complaints about defective customized products are always accepted — contact hello@22pack.com.

4.4 Defective goods. Your statutory rights in respect of defective or damaged goods are not affected by this section. Defective goods are refunded or replaced in full, including shipping costs.

5. Shipping Policy

Free Shipping: We offer free shipping across the European Union for orders over €120. Free shipping excludes the Canary Islands, Ceuta, Melilla, Malta and Cyprus; it does include Madeira and the Azores.
Custom Shipping: For orders outside the EU and below €120, shipping costs are calculated based on your location and purchased products.

Delivery times are estimates and may vary, particularly for locations outside the European Union or islands/overseas territories of EU countries.

7. Intellectual Property Rights

All intellectual property rights, including images, designs, and content on 22pack.com, are owned by Tamaraceite s.r.o. or have been licensed for use.

8. Prohibited Uses

Users of our website agree not to:

Violate any applicable laws or regulations.
Use the website for any illegal or unauthorized purposes.
Exploit, harm, or attempt to harm others, including minors, in any way.
Upload or transmit any viruses, worms, or malicious code.

9. Limitation of Liability

In no event shall Tamaraceite s.r.o. be liable for any indirect, incidental, special, consequential, or punitive damages arising out of the use of our products or services. Our maximum liability to you under all circumstances is limited to the amount paid by you for the product.

We are not liable for any delays or failures in delivery caused by events outside of our reasonable control, including but not limited to natural disasters, pandemics, strikes, or carrier issues.

10. Governing Law and Jurisdiction

10.1 Governing law. These Terms, and any contract concluded under them, are governed by the law of the Czech Republic, excluding its conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

10.2 Business customers. Where you purchase in the course of your trade or business, the courts of the Czech Republic have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or any contract concluded under them, and the competent court shall be the court having local jurisdiction over the registered seat of Tamaraceite s.r.o.

10.3 Consumers. If you are a consumer, the choice of Czech law above does not deprive you of the protection afforded by the mandatory provisions of the law of the country in which you are habitually resident. Jurisdiction over consumer disputes is determined by applicable law, and nothing in this section limits your right to bring proceedings in the courts of your country of residence.

10.4 Out-of-court resolution. Consumers in the Czech Republic may submit a dispute to the Czech Trade Inspection Authority (Česká obchodní inspekce, www.coi.cz) as the competent body for out-of-court settlement of consumer disputes.

11. Changes to the Terms

We reserve the right to modify these terms at any time. Any changes will be effective immediately upon posting on this page and apply to orders placed after that time. Continued use of the website following any such changes shall constitute your acceptance of the new terms.
